By downloading, installing, or using the Kkul mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Holofy Limited ("we," "our," or "us") regarding your use of the App.
2. Description of Service
Kkul is an AI-powered beauty transformation app that allows users to:
- •Upload photos for AI-powered beauty transformations
- •Apply various beauty presets and effects inspired by K-beauty aesthetics
- •Generate transformed images using artificial intelligence
- •Save and share generated images
3. Account Registration
To use certain features of the App, you must create an account using Sign in with Apple. You agree to:
- •Provide accurate and complete information
- •Maintain the security of your account credentials
- •Accept responsibility for all activities under your account
- •Notify us immediately of any unauthorized use
4. Credits & Payments
4.1 Credit System
The App uses a credit-based system for AI generations:
- •New users receive 3 free credits upon registration
- •Each AI generation uses 1 credit
- •Additional credits can be purchased through in-app purchases
4.2 Purchases
All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Credit purchases are:
- •Non-refundable except as required by law
- •Non-transferable between accounts
- •Subject to our current pricing
5. User Content
5.1 Your Photos
You retain ownership of photos you upload. By uploading photos, you grant us a limited license to process them for the purpose of providing the service.
5.2 Prohibited Content
You agree not to upload photos that:
- •Contain nudity or sexually explicit content
- •Depict violence, abuse, or harmful content
- •Infringe on others' intellectual property or privacy rights
- •Contain images of minors without parental consent
- •Violate any applicable laws or regulations
5.3 Generated Content
AI-generated images are provided for personal, non-commercial use. You may share generated images on social media with appropriate disclosure that they are AI-generated.
6. Prohibited Uses
You agree not to:
- •Use the App for any illegal purpose
- •Create deepfakes or misleading content intended to deceive
- •Impersonate others or misrepresent your identity
- •Attempt to reverse engineer or extract our AI models
- •Use automated systems to access the service
- •Interfere with or disrupt the service
- •Violate others' rights or privacy
7. Intellectual Property
The App, including its design, features, and content (excluding user-provided content), is owned by Holofy Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:
- •The service will be uninterrupted or error-free
- •AI-generated results will meet your expectations
- •Generated images will be accurate or realistic
9. Limitation of Liability
To the maximum extent permitted by law, Holofy Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination:
- •Your right to use the App will immediately cease
- •Unused credits will be forfeited
- •We may delete your account data
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Continued use after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles.
